NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A FREE INSURANCE QUOTE OR PURCHASE FROM A FARMERS AGENT OR ANY OF ITS AFFILIATES, OR PAYMENT OF ANY KIND, DOES NOT AND WILL NOT INCREASE YOUR ODDS OF WINNING. CONTEST VOID WHERE PROHIBITED.

DETAILS OF THE PRIZES AND HOW TO ENTER THE CONTEST ARE CONTAINED IN THESE OFFICIAL RULES.

ELIGIBILITY: The “FARMERS® INSURANCE PRESENTS “THANK A MILLION TEACHERS” CONTEST” (the “Contest”) is open to full-time, employed school teachers, Kindergarten (K) through Twelfth (12th) Grade, who have been officially thanked at thankamillionteachers.com, who are legal residents of the United States, excluding where otherwise prohibited by law, rule or regulation, which are at least 18 years of age at the time of entry. THIS CONTEST IS SPECIFICALLY VOID OUTSIDE THE UNITED STATES, IN PUERTO RICO, AND WHEREVER PROHIBITED BY LAW. NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN CONTEST AND IT WILL NOT INCREASE YOUR ODDS OF WINNING.

Employees of Farmers Group, Inc. (“Sponsor”) and Farmers Insurance Exchange or any of their promotional or advertising agencies with regard to this Contest and each of its and their respective parents, affiliates and subsidiaries, and each of their respective officers, employees, directors, members, legal representatives, agents, district managers, successors and assigns are not eligible, nor are members of these employees’ families (defined as parents, children, siblings, spouse, and life partners). Proof of legal U.S. residency, proof of employment as a full-time school teacher (K-12th grade) at time of entry and at time of prize award and age may be required. The Winner must be a full-time, employed school teacher in the United States at the time of entry and on the date the Prize is awarded.

HOW TO ENTER: The Contest begins at 9:00 a.m. (Pacific Standard Time (“PST”) on January 1, 2014 and officially ends at 11:59:59 p.m. PST on December 31, 2014. The Contest will consist of five (5) Contest periods (“Contest Period(s)”) with five (5) Contest Entry Periods (“Contest Entry Period(s)”) and five (5) Contest Voting Periods (“Contest Voting Period(s)”) where up to thirty (30) winners (up to six (6) winners per TAMT Zone) will be declared for each Contest Period. A total of up to 150 winners will be declared during the Contest. The Contest Periods, Contest Entry Periods and Contest Voting Periods will be as follows:

Individuals (the “Contestant” or “Entrant”) can enter the Contest by submitting a proposal during each Contest Entry Period by clicking on the “Submit A Proposal” icon located at the top of the “Thank A Million Teachers” website located at thankamillionteachers.com and following the proposal instructions (“Entry”). Entries are limited to one (1) Entry per Contestant per Contest Period. During the Contest Period, the Sponsor will review and judge the proposals. At the end of the Contest Entry Period, Sponsor will select up to 100 Entries (the “Finalists”) for each geographical zone (“TAMT Zones”) to be posted online at thankamillionteachers.com for voting by the general public during the Contest Voting Period. The TAMT Zones and states in each zone are as follows:

TAMT Zone 1: Alaska, Washington, Oregon, Idaho, Montana, Wyoming, Utah and Colorado;
TAMT Zone 2: Hawaii, California, Nevada, Arizona and New Mexico;
TAMT Zone 3: North Dakota, South Dakota, Nebraska, Minnesota, Iowa, Wisconsin, Illinois, Michigan and Indiana;
TAMT Zone 4: Kansas, Missouri, Oklahoma, Arkansas, Mississippi, Louisiana and Texas;
TAMT Zone 5: Maine, Vermont, New Hampshire, Massachusetts, Rhode Island, Connecticut, New York, New Jersey, Delaware, Ohio, Pennsylvania, Maryland, West Virginia, Virginia, Kentucky, Tennessee, North Carolina, South Carolina, Alabama, Georgia and Florida.

Please note all states listed do not necessarily apply because Contest may be void in some states.

The Finalists in each TAMT Zone may be voted on by the general public one time per day during the applicable Contest Voting Period. The top six Finalists who receive the most votes in each TAMT Zone will be declared the Winners (“Winners”) for that TAMT Zone and each Winner will be awarded the Prize. Up to thirty (30) total Winners will be declared per Contest Period. Individuals who do not submit their Entry and/or do not meet the additional eligibility requirements as set forth above will not be eligible to win a Prize. Sponsor’s computer is the official clock for all purposes related to the Contest.

Sponsor, Farmers Insurance Exchange, Sponsor Affiliates, Adopt a Classroom and National Board for Professional Teaching Standards and each of its advertising or promotion agencies with regard to the Contest and each of its and their respective parents, affiliates and subsidiaries, and each of their respective officers, employees, directors, members, legal representatives, agents, successors and assigns (collectively, the “Released Parties”) are not responsible for lost, late, incomplete, garbled, illegible, or misdirected Contest entries, or for any error, human, technical or otherwise, which may occur in the processing of Contest entries. Proof of entry or participating in the Contest will not be deemed to be proof of receipt. All entries become the exclusive property of Sponsor and may not be acknowledged. Any use of robotic, automatic, programmed or similar entry methods will void all such entries by such methods. All Entries must be the original work and/or material of the Contestant.

SELECTION OF WINNER: There will be up to six (6) winners per TAMT Zone per Contest Period(the “Winner(s)”). A total of up to 150 Winners (30 Winners per Contest Period, 5 Contest Periods) will be declared over the course of the Contest. The decisions of Sponsor, including the selection of the Winner(s), are final and binding on all matters relating to this Contest. Odds of winning depend on the total number of Contestants during each Contest Period. Limit one (1) Prize(s) per Winner per Contest.

PRIZE(S): Each Winner may choose one (1) of the following (the “Prize(s)”):

  1. $2,500 credit to be used solely and only for classroom purposes through Adopt a Classroom, or
  2. Up to $2,500 to be spent solely and only for board certification through National Board for Professional Teaching Standards, or
  3. Any partial combination of (1) or (2) not to exceed $2,500 total Prize value.

Winner will not be receiving any cash or cash equivalent value. The $2,500 Prize value will be paid in the Winner’s name directly to either Adapt a Classroom or National Board for Professional Teaching Standards only. If Winner loses his or her position as a full-time school teacher before expending or using the entire $2,500 Prize amount, the unspent or unused portion of the Prize will be forfeited. All Prizes must be spent or used within one (1) year from the date of award of Prize or otherwise the Prize is forfeited.

Winner may be required to execute an Affidavit of Eligibility, a liability release, a publicity release, a general release, and/or other documents, including but not limited to tax documents, as applicable, except where prohibited by law. Winner may also be required to submit to and pass, to the Sponsor’s sole satisfaction, an extensive background check prior to the Prize award. Winner is solely and fully responsible for any and all applicable federal, state, and local taxes (including income and withholding taxes). All costs and expenses associated with Prize acceptance and use not specified herein as being provided, related to the Prize, including but not limited to, any taxes and other expenses incurred by accepting the Prize are the sole responsibility of the Winner. All Prize(s) are awarded “As Is”. Neither Sponsor, nor Farmers Insurance Exchange, nor any of Sponsor’s Affiliates, nor Released Parties, make, nor are they in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Prize(s) including but not limited to its quality, merchantability, fitness for a particular purpose or condition.

USE OF DATA: Sponsor may be collecting personal data about Contestants including, without limitation, name, phone number, email address, date of birth, biographical information, city and state of residence and zip code when Contestant enters the Contest or is selected as the Winner. Winner’s First and Last Name, representative school, photo, image, likeness and city and state of residence may be posted on www.Farmers.com, thankamillionteachers.com, and/or FarmersInsurance. Sponsor is entitled to use personal data contained in all entries in accordance with the Sponsor’s privacy policy. By participating in the Contest, Contestants hereby agree to all personal information uses and disclaimers as explained in Sponsor’s Privacy Policy located at Farmers.com. AGREEMENT TO OFFICIAL RULES: Participation in the Contest constitutes Contestant’s full and unconditional agreement to and acceptance of these Official Rules and Sponsor’s Privacy Policy at Farmers.com and to be contacted by telephone or email. Sponsor’s decisions are final and binding.

WINNER NOTIFICATION: Winner will be notified by the Sponsor via telephone or email. In the event that the Winner does not respond to any such notification within forty-eight (48) hours of the first such attempt, a disqualification may result and, at Sponsor’s discretion, an alternate Winner may be chosen from the Contestants with the next highest vote total. Winner is subject to qualification by the Sponsor.

Except where otherwise expressly noted in these Official Rules, the selection of all vendors, prizes, products and services is subject to the Sponsor’s sole and absolute discretion. Prize is nontransferable and non-exchangeable. No substitutions or cash redemption of Prize is permitted except that Sponsor retains the right to substitute a prize of equal or greater retail value (or at Sponsor’s election, the cash value of the applicable Prize). Additional restrictions may apply.

No refunds or credit for changes are allowed. No transfer of the Prize is permitted. Noncompliance within this time period may result in disqualification, and an alternate winner may be selected. Return of any Prize notification as undeliverable may result in disqualification and selection of an alternate Winner.

GENERAL CONDITIONS: The Contest is governed by the laws of the United States and the State of California, excluding conflicts of laws principles. All federal, state and local laws and regulations apply. Contestants and Winners hereby consent to the exclusive jurisdiction and venue of California courts (state and federal) in Los Angeles County for any causes or controversies arising out of the Contest. Contestants and Winners waive any and all objections to jurisdiction and venue in these courts.

Except where prohibited by law, Winners grant to Sponsor and its advertising agencies the right to use and publish Winner’s photo, image, name, likeness, voice, opinions, biographical information, representative school and city and state of residence in any media, currently known or unknown, and to promote the Contest without additional compensation. Winner may be required by Sponsor to participate in photo and/or video sessions. Winner agrees to make him/her available for publicity purposes including, but not limited to, photo and video sessions and public appearances without charge. Winner may be required to execute an Affidavit of Eligibility, liability release, publicity release, general release and other documents, if necessary, including but not limited to tax documents, as applicable, except where prohibited by law. Winner shall be solely responsible for all applicable taxes on the value of the Prize and, if applicable, will be issued an IRS 1099-MISC tax form for the real value of the Prize.

By entering, Contestants and Winners release, indemnify and hold harmless Sponsor and the Released Parties from any and all liability for any injuries, loss or damage of any kind, including death, arising from or in connection with the Contest or receipt or use and/or misuse of any Prize. Contestant and Winner hereby waive all rights to any claim(s), punitive, incidental or consequential damages, or any other damages whatsoever, including court costs and attorneys’ fees. Furthermore, Contestant and Winner agree that any and all disputes and causes of action arising out of or connected with this Contest and the Prize awarded shall be resolved solely by Sponsor, shall be final and binding, and without resort to any form of class action. Sponsor, Released Parties and its affiliates shall not be responsible for Acts of God, acts of terrorism, actions or inactions of any governmental entity (foreign or domestic) or its agencies and/or departments, civil unrest or disturbances, riots, work stoppage delays, postponements, inclement weather, rescheduling or any other natural disasters outside its respective control.

Sponsor reserves the right, in its own discretion, to cancel or modify the Contest or disqualify a Contestant, with or without cause, or if fraud or any other factor impairs the integrity of the Contest as determined by Sponsor in its sole discretion. If Sponsor cancels or modifies the Contest, Sponsor reserves the right to award or not award Prizes in its sole discretion.

Entries are deemed made by the authorized account holder of the email account and associated e-mail address at the time of entry submission. The “authorized account holder” is deemed the natural person who participates via his or her email account and is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the associated e-mail address. A potential Winner may be requested to provide Sponsor with proof that the potential Winner is the authorized account holder of the e-mail address account associated with the winning entry is a legal United States resident and complies with all the eligibility requirements of these Official Rules. Prize will only be awarded to the authorized account holder.

If, in Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if technical difficulties compromise the integrity of the Contest, Sponsor reserves the right in its sole discretion to void any entries at issue (including disqualifying any individual who tampers or otherwise interferes with the entry process), and to cancel, terminate, modify or suspend the Contest, in whole or in part, at any time without notice. In the event of such cancellation, Sponsor reserves the right to award the Prize(s) in a random drawing from all Contestants received before the time of cancellation.

Sponsor in no way promotes illegal acts, and any and all entries which include or promote illegal acts will be disqualified. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of unauthorized access to, or alternation of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, e-mail or entry received by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site, including www.farmers.com or thankamillionteachers.com, any combination thereof, or otherwise, including any injury or damage to Contestant’s or any other person’s computer related to or resulting from participation or downloading any materials in the Contest.

CAUTION: ANY ATTEMPT BY A CONTESTANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. SPONSOR ALSO RESERVES THE RIGHT TO IMMEDIATELY DISQUALIFY CONTESTANT.
